1. Nature of Service

HealthRec1 ("we," "our," or "the Service") provides a secure platform for individuals to store, organize, and manage their own personal health records. We do not have access to, control over, or custody of your health information. You maintain complete ownership and control of all data you choose to store using our Service.

2. Not a Healthcare Provider

HealthRec1 is a technology platform only. We are not:

  • A healthcare provider, physician, or medical professional
  • Providing medical advice, diagnosis, or treatment
  • A substitute for professional medical care
  • Subject to HIPAA as a covered entity or business associate

Always consult qualified healthcare professionals for medical decisions.

3. User Responsibility and Control

You are solely responsible for:

  • All health information you choose to store on the platform
  • The accuracy and completeness of your records
  • Deciding who (if anyone) to share your records with
  • Maintaining secure access credentials (passwords, authentication)
  • Creating independent backups of your important health data
  • Complying with any applicable laws in your jurisdiction
4. Zero-Knowledge Architecture

Our platform is designed with privacy in mind:

  • We do not access, view, or analyze your health records
  • Your data is encrypted and only accessible to you
  • We cannot recover your data if you lose your access credentials
  • We do not sell, share, or monetize your health information
5. Service Availability and Reliability

No Guarantee of Availability: While we strive to maintain reliable service, we do not guarantee:

  • Uninterrupted or error-free access to the platform
  • That the Service will meet your specific requirements
  • That all features will function perfectly at all times
  • Immunity from technical failures, outages, or data loss

Service may be temporarily unavailable due to maintenance, updates, technical issues, or circumstances beyond our control.

6. Data Security

We implement industry-standard security measures to protect the platform. However:

  • No system is completely secure from all threats
  • You acknowledge the inherent risks of storing data electronically
  • You are responsible for using strong passwords and secure devices
  • We are not liable for unauthorized access resulting from your failure to maintain security
7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: HealthRec1 and its officers, directors, employees, and affiliates shall NOT be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of data, profits, revenue, or business opportunities
  • Service interruptions or technical failures
  • Decisions made based on information stored in your records
  • Medical outcomes or healthcare decisions
  • Damages arising from your use or inability to use the Service

MAXIMUM LIABILITY: Our total liability to you for any claims shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

8. Exceptions to Limitations

These limitations do NOT apply to liability that cannot be excluded by law, including:

  • Death or personal injury caused by our gross negligence
  • Fraud or fraudulent misrepresentation
  • Violations of consumer protection laws that prohibit limitation
  • Any other liability that cannot be limited under applicable law
9. Third-Party Services and Links

Our Service may integrate with or link to third-party services (cloud storage, healthcare providers, etc.):

  • We are not responsible for third-party services, content, or privacy practices
  • Your use of third-party services is governed by their terms and policies
  • We do not endorse or guarantee third-party services
10. Data Backup Responsibility

  • Regularly exporting your data
  • Maintaining copies in multiple secure locations
  • Not relying solely on HealthRec1 as your only record storage
11. Account Termination

We reserve the right to suspend or terminate accounts that:

  • Violate our Terms of Service
  • Engage in fraudulent or illegal activity
  • Compromise platform security
  • Remain inactive for extended periods (with notice)

Upon termination, you are responsible for exporting your data before access is removed.

12. No Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, either express or implied, including but not limited to:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy or reliability
13. Indemnification

You agree to indemnify and hold harmless HealthRec1 from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these terms
  • Your violation of any rights of another party
  • Content you store or share through the platform
14. Changes to Service and Disclaimer

We reserve the right to:

  • Modify or discontinue the Service at any time
  • Update this disclaimer with reasonable notice
  • Change features, pricing, or terms of service

Continued use after changes constitutes acceptance of modifications.

15. Governing Law and Disputes

This disclaimer is governed by the laws of the State of Oklahoma, without regard to conflict of law principles.

Dispute Resolution: Any disputes shall be resolved through:

  • Good faith negotiation
  • Mediation (if negotiation fails)
  • Binding arbitration in Oklahoma City, Oklahoma (if mediation fails)

You waive the right to participate in class action lawsuits.

16. Severability

If any provision of this disclaimer is found unenforceable, the remaining provisions shall remain in full effect.
